1. Who We Are

Agenary ("we," "our," "us") provides AI-powered lead conversion services for businesses. Our system contacts individuals on behalf of our business clients, conducts qualification conversations, and books appointments — fully automated.

2. Our Role

Agenary acts as a Data Processor under Israeli Privacy Protection Law (PPL), 5741-1981, as amended by Amendment 13 (in force August 14, 2025). Our business clients are the Data Controllers — they are responsible for obtaining lawful consent from individuals before submitting data to our system.

3. What Data We Collect

We collect only what is necessary to deliver the contracted service. This includes:

  • Contact details provided during the lead intake process (name, phone number)

  • Information voluntarily shared during the AI conversation (service interest, preferences)

  • Appointment details (requested date, time, confirmed booking)

  • Call metadata (timestamps, outcome, number of attempts)

  • Consent status and opt-out records — documented per contact

4. How We Use Your Data

Data is used solely to deliver the contracted service:

  • Placing outbound AI voice calls on behalf of business clients

  • Conducting qualification conversations

  • Booking appointments into the client's calendar

  • Sending appointment confirmation messages

  • Tracking lead status and compliance records

  • Honoring opt-out requests immediately and permanently

We do not use personal data for advertising, profiling, or any secondary purpose. We do not sell or rent personal data to any third party.

5. Legal Basis for Processing

Consent — Our business clients confirm that each individual has provided valid, documented consent to be contacted. Consent is logged with a timestamp per contact.

Legitimate interest — Follow-up contact within the scope of an existing inquiry, where applicable under Israeli law.

Legal obligation — Consent records, opt-out logs, and call history are retained to demonstrate compliance with applicable law.

AI Disclosure — Our AI voice agent identifies itself as an AI system within the first 10 seconds of every call, in compliance with Amendment 13 and the Israeli Privacy Protection Authority's guidelines on AI systems.

Opt-Out — Any individual who requests to stop being contacted is removed from all contact lists immediately during the call and permanently thereafter.

Calling Hours — Outbound contact is limited to Sunday–Thursday, 09:00–20:00 Israel Standard Time. No contact is made Friday 14:00 through Sunday 08:00 under any circumstances.

6. Third-Party Service Providers

To deliver our service, we work with trusted third-party providers in the following categories: voice and telephony infrastructure, AI processing, calendar and email delivery, and CRM storage. Each provider processes only the data necessary for their specific function, under contractual data protection obligations.

We do not transfer personal data to providers for advertising, model training, or any purpose beyond service delivery.

Google API Services — We use Google Calendar and Gmail APIs to create appointments and send confirmation messages on behalf of business clients. Agenary's use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy (https://developers.google.com/terms/api-services-user-data-policy), including the Limited Use requirements. Google Calendar access is limited to creating events related to the booked appointment. Gmail access is limited to sending confirmation messages only. We do not read, store, or analyze inbox contents or any unrelated calendar data.

7. Data Storage and Retention

Personal data is stored securely using our service infrastructure, with encryption in transit and at rest. Access is restricted to authorized personnel only. Each client's data is kept isolated from other clients.

Data is retained for no longer than 90 days from the date of last contact, in line with Amendment 13 requirements, unless a confirmed appointment or active business relationship requires a longer period. After this, records are anonymized or deleted.

8. Your Rights

Under Israeli Privacy Protection Law (amended by Amendment 13), you have the right to:

  • Access — request a copy of personal data we hold about you

  • Correction — request correction of inaccurate data

  • Deletion — request deletion of your data, subject to legal retention obligations

  • Opt-out — request immediate permanent removal from all contact

  • Complaint — lodge a complaint with the Israeli Privacy Protection Authority (Reshut HaGanat HaPrivatiyut)

9. Changes to This Policy

We may update this policy as our services or legal obligations change. The date at the top reflects the most recent revision. Business clients will be notified of material changes by email. Continued use of our services after a change constitutes acceptance of the updated policy.
